Terms of Service

These Terms of Service (“Terms”) are an agreement between you and Idiomi, LLC (“Idiomi,” “we,” “us,” or “our”) governing your use of Read Spanish Daily at readspanishdaily.com (the “Service”). By creating an account or using the Service, you agree to these Terms and acknowledge the Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility and accounts

You must be at least 13, be legally able to enter this agreement, and live in one of the 50 United States or the District of Columbia. If you are under 18, you may use the Service only with permission from a parent or legal guardian who agrees to these Terms on your behalf. The Service is not intentionally offered in U.S. territories or countries outside the United States. You must provide accurate information, keep access to your email account secure, and not allow another person to use your account. Notify us promptly at legal@idiomi.com if you suspect unauthorized access.

2. The Service and free experience

Read Spanish Daily provides short Spanish reading lessons adapted to your selected learning level and regional preference. After you submit your email address, delivery preferences, and request for story emails, you receive one free story per local calendar day on an ongoing basis, with no three-day limit. You can unsubscribe at any time. You do not need to verify or log in before those emails begin, but you must verify control of the address before accessing account, settings, billing, push, or history features. No payment card is required, and the free experience does not create a paid subscription or charge. We may change future features or content, but changes do not alter rights already earned under a paid period or access to stories previously assigned, except where access must be restricted for legal or security reasons.

3. Annual subscription, automatic renewal, and taxes

Premium learning is an optional subscription costing $12 USD per year. Daily stories, translations and phrase help remain free. The subscription automatically renews each year until canceled. A third-party payment processor handles payment details, receipts, and subscription changes. Previously authorized annual plans retain their agreed first-charge schedule and can be canceled before they start. Saving a payment method does not itself grant Premium. Paid access activates or renews only after a successful payment.

By starting the annual subscription, you authorize Idiomi and its payment processor to charge the disclosed annual price and applicable taxes at each renewal unless you cancel before the renewal is processed. The displayed subscription price does not include taxes. If Idiomi is required to collect tax, the amount will be shown before you authorize the charge. Price changes will apply only after the notice required by applicable law and will not retroactively change an already-paid period.

4. Cancellation, failed payments, and access

You may manage payment details, receipts, cancellation, and supported reactivation through the billing portal. Cancellation ordinarily takes effect at the end of the current paid period, and access continues through that date. If a renewal payment fails, Read Spanish Daily may continue access through a seven-day grace period while the payment processor attempts recovery. An ended subscription, an unpaid state, or an expired grace period ends Premium access. Enrolled free daily reading continues according to your delivery preferences. Stories already assigned remain readable.

5. Refunds

You may request a full refund, with no reason required, within 30 calendar days after the initial paid invoice or any renewal paid invoice. A full refund ends that paid Premium period; enrolled free daily reading continues and stories already assigned remain readable. We do not provide partial or prorated refunds after the 30-day window except where required by law.

We will refund a verified duplicate, mistaken, or unauthorized charge in full. Contact us within 60 days so we can investigate promptly; this request period does not limit non-waivable bank, card-network, or statutory rights. Email legal@idiomi.com from the account email address with the account email, approximate charge date, and reason category. Do not send a full card number. We will acknowledge the request within five business days. Your bank controls posting time after the payment processor issues an approved refund. Nothing in these Terms limits a refund or cancellation right that cannot lawfully be waived.

6. Founding Lifetime and complimentary access

Customers previously granted Founding Lifetime Access retain permanent access and are not automatically enrolled in or billed for the annual subscription. Idiomi may also grant, extend, shorten, or revoke complimentary access separately from a paid subscription. Complimentary access creates no payment obligation and may be subject to its stated duration, acceptable-use rules, and the proportionate suspension terms below.

7. Limited license and intellectual property

Subject to these Terms, Idiomi grants you a limited, revocable, non-exclusive, non-transferable right to use the hosted Service and assigned lessons for personal learning. You may not sell, sublicense, publicly distribute, republish, scrape, or systematically reproduce the Service or lesson library except where law expressly permits it. Idiomi and its licensors retain their rights in the Service, software, branding, compilation, and lesson editions. Send a copyright or trademark complaint to legal@idiomi.com with identification of the protected work, the challenged material, your contact information, a good-faith statement, an accuracy and authority statement, and your signature.

8. Acceptable use

You may not bypass access controls; probe or interfere with security; scrape or use automated access that burdens the Service; misuse sign-in, email, or notification features; access another person’s account; attempt to discover confidential technical information; introduce malicious code; infringe intellectual-property or privacy rights; redistribute lesson content beyond the personal-use license; or use the Service unlawfully.

9. Educational content

The Service provides content for supplemental personal language learning. It is not formal certification, professional instruction, or a professional translation service. You remain responsible for deciding how to use the content and for verifying information before relying on it for an important purpose.

10. Third-party services and links

The Service depends on third-party vendors and may link to third-party sites, including hosted billing pages. Their terms and privacy practices may apply to your use of those services. We are not responsible for third-party sites or services outside our control, subject to applicable law.

11. Changes, suspension, and termination

We may maintain, improve, modify, or discontinue parts of the Service. We may immediately restrict access when reasonably necessary to address unlawful activity, fraud, a credible security threat, access-control abuse, harm to another person, or a legal requirement. For other material violations, we will ordinarily provide email notice and 14 calendar days to cure where cure is practical. Nonpayment follows the payment-grace and cancellation rules above. We may close an inactive free account after 12 months without sign-in only after at least 30 days’ email notice. Suspension and termination will be proportionate. Account closure stops new assignments unless law, security, fraud, intellectual-property obligations, or the personal-use license requires a narrower restriction; previously assigned stories otherwise remain readable. Provisions that by their nature should survive termination will survive.

12. Disclaimers

To the maximum extent permitted by law, the Service is provided “as is” and “as available.” Idiomi disclaims implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement and does not promise uninterrupted, error-free, or completely accurate service. This does not exclude warranties or consumer rights that cannot lawfully be waived.

13. Limitation of liability

To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, consequential, exemplary, or punitive damages or lost profits arising from the Service. Idiomi’s total liability for all claims will not exceed the greater of $100 or the amount you paid Idiomi during the 12 months before the event giving rise to the claim. These limitations do not apply to fraud, willful misconduct, gross negligence, or liability that cannot lawfully be limited.

14. Indemnification

These consumer Terms do not require you to indemnify Idiomi. This does not limit ordinary remedies for unlawful conduct or a violation of another person’s rights.

15. Governing law and disputes

Delaware law and applicable United States federal law govern these Terms without regard to conflict-of-law rules, but this choice does not deprive you of non-waivable protections of your home state. A dispute may be brought in the state or federal courts located in Delaware. Either party may instead bring an eligible individual claim in small-claims court where you live.

Before filing a non-small-claims dispute, the complaining party should email legal@idiomi.com with a short description and requested resolution and allow 30 calendar days for good-faith informal resolution. This does not prevent either party from seeking urgent injunctive relief or meeting a statutory deadline. These Terms do not require arbitration and do not contain a class-action waiver.

16. General terms

If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law. A failure to enforce a provision is not a waiver. You may not transfer your account or rights under these Terms without our permission. Idiomi may assign these Terms as part of a merger, acquisition, financing, reorganization, or sale of the relevant business, subject to applicable law. These Terms, the Privacy Policy, and any checkout disclosures form the agreement concerning the Service unless a separate signed agreement applies.

17. Changes to these Terms

We may update these Terms as the Service or legal requirements change. We will provide both email notice to the current service email address and a prominent notice in the Service at least 30 calendar days before a material change takes effect. A shorter period may be used only when required to address law, fraud, abuse, or an urgent security risk, and the notice will explain the accelerated timing. Non-material clarifications may take effect when posted. Changes to subscription pricing or renewal terms will receive any additional notice required by law.
